Welcome to At Dawn, operated by At Dawn Ministries ("we," "us," or "our"). These Terms of Service ("Terms") govern your use of At Dawn (the "App"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Purpose of the App

At Dawn is designed to provide spiritual encouragement through Bible reading, devotionals, topical studies, journaling, prayer tracking, and group study features. The App is intended to support personal spiritual growth and engagement with Scripture.

The content provided in the App is for educational and devotional purposes only. This App does not provide professional counseling, therapy, pastoral care, medical advice, or legal advice. Users seeking professional assistance should consult a qualified professional.

2. Eligibility

You must be at least 13 years old to use the App without parental consent. Children under the age of 13 may use the App only with parental supervision. By using the App, you confirm that you meet these eligibility requirements.

3. User Accounts

Some features of the App may allow you to create an account for syncing data across devices. You are responsible for maintaining the confidentiality of your account credentials and all activity occurring under your account.

You agree to provide accurate information when creating an account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Group Features and User Content

The App allows users to submit content within private study groups, including prayer requests, celebrations, conversations, and replies. By submitting content, you agree that:

• You are responsible for the content you post.
• Your content does not violate any laws or the rights of others.
• Your content does not contain hateful, threatening, abusive, or harmful material.

Users must not harass or bully other users, post obscene or offensive material, share illegal content, post spam or promotional advertising, or impersonate another person.

We reserve the right to remove user-generated content, restrict access to group features, and suspend accounts that violate these guidelines.

5. Private Group Content

Content shared within study groups is visible only to members of that group. Group administrators may moderate content within their groups. Users should exercise discretion when sharing personal information within groups. Content shared externally via the share feature is the responsibility of the sharing user.

6. Intellectual Property

All content within the App, including text, design, graphics, layout, software code, devotional materials, and studies, is the property of At Dawn Ministries unless otherwise noted.

Scripture quotations primarily use the King James Version (KJV), which is in the public domain. Other Bible translations, when used, are attributed to their respective copyright holders. Users may not reproduce, distribute, or commercially exploit App content without permission.

7. Content Generation Disclosure

Some study materials, devotionals, or educational content within the App may be generated using automated tools. Such content is reviewed prior to publication but may not represent the views of any particular denomination or theological tradition.

Users are encouraged to study Scripture directly and consult trusted biblical resources.

8. Mental Health Disclaimer

At Dawn is not a substitute for professional mental health services. While Scripture and spiritual encouragement may provide comfort, the App should not replace professional medical or psychological care.

9. Health, Wellness, and Nutrition Disclaimer

The App includes wellness-related features such as recipes, nutrition calculators, body composition estimators, meal planners, fitness suggestions, and dietary information. This content is provided for general educational and informational purposes only and does not constitute medical advice, diagnosis, or treatment.

You should always consult a qualified healthcare provider before beginning any diet, exercise, supplement, or wellness program, or if you have questions about a medical condition. Never disregard professional medical advice or delay seeking treatment because of information provided through the App.

Nutritional values, calorie calculations, body fat estimates, and other computed data are approximations and may not reflect your individual circumstances. The App is not intended to diagnose, treat, cure, or prevent any disease or health condition.

At Dawn Ministries is not a healthcare provider, licensed dietitian, or medical professional. The App does not establish a provider-patient relationship. Any reliance on wellness content is at your own risk.

10. Assumption of Risk

By using the App, you acknowledge and agree that you use all features, including wellness content, recipes, exercise suggestions, dietary recommendations, community features, and spiritual guidance, at your own risk. You voluntarily assume all risks associated with your use of the App.

You are solely responsible for any dietary decisions, lifestyle changes, or actions taken based on information provided through the App. If you have allergies, food sensitivities, medical conditions, or take medications, you are responsible for evaluating whether any recipe, food, or wellness suggestion is appropriate for you.

11. Acceptable Use

You agree not to use the App to violate any applicable laws or regulations, distribute malicious software, attempt to access unauthorized areas of the App, disrupt or interfere with App functionality, or scrape or extract data from the App without permission.

12. Termination of Access

We reserve the right to suspend or terminate access to the App, in whole or in part, if a user violates these Terms, engages in abusive or harmful conduct, or attempts to disrupt the service. Termination may occur without prior notice. Upon termination, your license to use the App ceases immediately. Provisions regarding intellectual property, disclaimers, limitation of liability, indemnification, arbitration, and governing law survive termination.

13. Third-Party Links and Content

The App may contain links to third-party websites, services, or resources, including supplement providers, crisis hotlines, counseling directories, and external content. At Dawn Ministries does not control, endorse, or guarantee the accuracy, relevance, or completeness of any third-party content or services.

Your interactions with third-party sites or services are solely between you and the third party. We are not liable for any damage or loss caused by your reliance on third-party content or services.

14. Copyright and DMCA Policy

At Dawn Ministries respects the intellectual property rights of others. If you believe that content available through the App infringes your copyright, you may submit a notice in accordance with the Digital Millennium Copyright Act (DMCA) to our designated agent at legal@atdawnministries.org.

Your notice must include identification of the copyrighted work, the allegedly infringing material, your contact information, a statement of good faith belief, and a statement of accuracy under penalty of perjury. We will respond to valid DMCA notices in accordance with applicable law and may remove or disable access to the infringing content.

15. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AT DAWN MINISTRIES DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, UNINTERRUPTED SERVICE, ACCURACY OF CONTENT, AND FREEDOM FROM ERRORS OR VIRUSES.

We do not warrant that the App will meet your requirements, that access will be uninterrupted, timely, secure, or error-free, or that any content, including wellness information, recipes, calculators, nutritional data, devotionals, or generated content, will be accurate, complete, or reliable.

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AT DAWN MINISTRIES, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE APP EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

17. Indemnification

You agree to indemnify, defend, and hold harmless At Dawn Ministries, its officers, directors, employees, agents, and affiliates from and against all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use of the App, your violation of these Terms, your posted content, your violation of any third-party rights, or any dietary, health, or lifestyle decisions you make based on App content.

18. Arbitration and Dispute Resolution

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

You and At Dawn Ministries agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App shall be resolved through binding individual arbitration rather than in court, except that either party may bring claims in small claims court if eligible.

Arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in English. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver: YOU AND AT DAWN MINISTRIES AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.

Opt-Out: You may opt out of this arbitration agreement by sending written notice to legal@atdawnministries.org within 30 days of first accepting these Terms. If you opt out, the Governing Law section below will apply to disputes.

19. Subscription Plans and Pricing

The App offers both free and premium subscription plans. Premium subscriptions are available on a monthly or annual basis and may include a free trial period. Subscription features, pricing, and availability are subject to change at any time.

Premium subscriptions are processed through Apple App Store or Google Play Store and are subject to their respective billing terms. You may manage or cancel your subscription through your device's app store settings.

Refund Policy: Subscription payments are processed by Apple or Google and are subject to their respective refund policies. At Dawn Ministries does not process refunds directly. To request a refund, contact Apple App Store or Google Play support. We cannot guarantee that refund requests will be approved, as that decision rests with the applicable app store.

Free Trial: If a free trial is offered, it converts to a paid subscription at the end of the trial period unless cancelled at least 24 hours before the trial ends. Only one free trial is available per account.

20. Charitable Giving Commitment

At Dawn Ministries is committed to supporting communities in need. We currently donate approximately 10% of subscription revenue to charitable causes and organizations aligned with our mission.

This commitment is voluntary and may be adjusted at our discretion. The specific percentage, recipient organizations, and terms of charitable giving may change over time. This commitment does not create a contractual obligation to any user, subscriber, or third party. Subscription fees are not tax-deductible as charitable contributions.

21. Force Majeure

At Dawn Ministries shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, epidemics, pandemics, war, terrorism, riots, government actions, power failures, internet or telecommunications failures, cyberattacks, or any other event that is unforeseeable or beyond our reasonable control.

22. Electronic Communications

By using the App, you consent to receive electronic communications from us, including push notifications (if enabled), in-app notices, and communications to the email address associated with your account. You agree that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that such communications be in writing.

23. Export Compliance

You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations maintained by the U.S. Department of Commerce and sanctions programs administered by the U.S. Treasury Department's Office of Foreign Assets Control. You may not use or access the App if you are located in a country subject to a U.S. government embargo or if you are a prohibited party under applicable export laws.

24. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions.

25. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and At Dawn Ministries regarding your use of the App and supersede all prior agreements, understandings, and communications, whether oral or written.

26. No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by At Dawn Ministries.

27. Changes to These Terms

We may update or modify these Terms from time to time. When material changes occur, we will provide notice through the App or by other appropriate means. The updated Terms will be posted with a revised Effective Date. Continued use of the App after changes indicates acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the App.

28. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the United States and the applicable state in which At Dawn Ministries operates, without regard to conflict of law principles. Subject to the Arbitration section above, any legal proceedings shall be brought in the courts located in the state where At Dawn Ministries operates.
